Attestation or apostille: getting your documents accepted in Baku

Azerbaijani registrars and migration officers accept a foreign document only if it has been legalised for use in Azerbaijan and translated into Azerbaijani by a notarised translator. Which legalisation you need depends on one fact: whether the country where the document was issued or signed is a party to the Hague Apostille Convention.

Which route applies to you

Azerbaijan joined the Apostille Convention in 2005. A document from another party country needs a single apostille certificate from that country's designated authority and nothing more. A document from a non-party country needs consular legalisation: the issuing country's foreign ministry, then the Azerbaijani embassy accredited to that country.

The UAE chain: notary, MOFAIC, embassy

  1. Notary. Private documents such as a shareholder resolution or a power of attorney are signed before a UAE notary, who issues a bilingual notarial certificate. Government-issued documents such as a trade licence or a certificate of formation skip this step.
  2. MOFAIC attestation. Through the Ministry's portal with UAE Pass. Documents that carry a verifiable QR code from a UAE authority go through the digital route in about two hours. Notarised paper documents go by courier in one to three business days. Select Azerbaijan as the destination and the option for attestation by the destination country's embassy in the UAE. The fee is AED 2,000 for a commercial document and AED 150 for a personal certificate.
  3. Embassy of Azerbaijan in Abu Dhabi. Consular legalisation of the attested document. Consular hours are limited, so book the visit.

For a branch registration this chain is run on five documents, which is why the UAE route costs around AED 10,000 in attestation alone.

The apostille route: Pakistan and other Hague countries

Where the document comes from a Hague country, one stamp replaces the ministry-plus-embassy pair. In Pakistan the Ministry of Foreign Affairs issues apostilles at its Islamabad head office and at camp offices in Karachi, Lahore, Peshawar and Quetta. A notarised private document or a certified copy from a public registry such as the SECP is presented, the fee is a few hundred rupees, and the apostilled document is accepted in Azerbaijan without any embassy step.

Saving in practice. A company registered in both the UAE and Pakistan that opens a branch in Baku through its Pakistani entity pays a few dollars in apostilles instead of about AED 10,000 in attestation. The registration, residency and bank steps are otherwise identical.

Why the place of signing matters

An apostille can only be issued by the country where the document was notarised or issued. A board resolution signed in Dubai cannot be apostilled in Islamabad, and a resolution notarised in Islamabad cannot go through MOFAIC. Decide the legalisation route first, then sign in that country. For companies with directors in two countries this usually means one director travels for a single notary sitting, or the resolution is passed by circulation with each counterpart legalised where it was signed.

Translation in Baku

Every legalised document, and the passport pages of each applicant, is translated into Azerbaijani by a translator whose signature a Baku notary certifies. Bureaus accept scans by e-mail and hand over the originals when you arrive. Budget 10 to 20 AZN per page; a branch file with the parent pack runs to about 45 pages.
